Illegal Parking The week of August 24,2007, the County Council passed and signed by the Executive John R.Leopold to fine violators who park illegal in the handicap zones $500.00. The police will be checking for persons that do not have a handicapped permit who parks their vehicles in the hndicapped areas. Illegal Immigrants The County Executive John R. Leopold issued an executive order the week of August 17,2007 that will require bussinesses to sign an affidavit swearing they do not employ people living in the Country illegally. Evidence that a company has hired illegal immigrants would constitute a "material breach of contract", allowing the County to drop the contractor from the job. The Sunpapers of October 24,2007 had an article that Prince Williams County Virginia, passed a law that will crack down on illegal immigrants that might bring a mass relocation to welcoming states lke Maryland. The new law bars illegal immigrants from obtaining business licenses or using services for the homeless,elderly and drug-addicted. In addition , police must check suspects status if there is reason to believe they are here illegally. Lawnmower emissions The Environmental Protection Agency has proposed new rules for engines under 25 horsepower, which power nearly all walk-behind and riding lawnmowers, as well as small generators and other devices. The rule is intended to cut smog-forming emissions from the engines by 35 percent probably by adding catalytic converters that reduce pollution from exhaust. The new rule would take effect in 2011 for riding mowers and 2012 for push mowers. It would apply only to new engines. The new rule also would put new emission controls on powerboat and outboard engines starting with the 2009 model year that would result in a 70% reduction in smog-forming emmissions from those engines. Noise pollution Anne Arundel County has become the first county in Maryland to enforce the state's more stringent noise pollution laws, according to the County Excutive John R. Leopold. Police can fine people up to $10,000.00 for each day they are cited for exceeding 65 decibels from 11 P.M. to 7 A.M., and 75 decibels at other times. The county focus for enforcement will be on nighttime noise in residential neighborhoods. An Officer must witness the act just like a traffic violation , to cite an infraction. Six officers have been trained to use the noise meter. |

Bills that were passed HB930 Known as Jessica's Law, requires a 25 year mandatory minimum sentence for 1st.degree rape of a child 13 or under in which the offender must be 18 years or older with no possibility of parole. Second degree rape of a child 13 years of age or under, where the offender is 18 years of age or older, requires the mandatory minimum sentencing of 5 years with no possibility of parole. Please Note;According to the August 25,2007 of the Sun Papers, the convicted sex offender John Evander Couey that raped and buried alive 9 year old Jessica Lunsford was tried in Inverness,Florida and got the death sentence. This led to new laws in many states known as Jessica's Law. SB488 Voting Rights for Felons HB992 This law drastically cuts mandatory sentences for second time offenders from 10 years to 2 1/2 years for persons that are drug dealers,pushers and users who have been convicted of drug offenses. HB579 Allows insurance companies to offer a product for businesses to employees who work less than 30 hours a week or who work seasonal jobs. HB 339 Will reward employers who offer "wellness programs". An employer, who offers programs like smoking cessation & weight management, will be rewarded with a discount up to 20% off of their health insurance cost. SB519 Requiring specified applicants for a learner's instructional permit to present to the Motor Vehicle Administration the applicant's school attendance record. and prohibiting the Administration from issuing a learner's instructional permit to specified applicants if the applicant's school attendance record indicates more than 10 unexcused absences during the prior school semester. Another law that was passed in October of 2006 concerns drivers under the age of 21 convicted of drunken or drugged driving, they would lose their license for one year. A second offense, the license will be lost for two years. Delegate Nic Kipke has introduced a bill that would allow courts to order the Motor Vehicle Administration to suspend the driver's license or driving privilege of any juvenile convicted of destroying property with graffiti. In the proposed legislation, the first offense would mean a six-month suspension, with subsequent offenses resulting in suspensions of one year or until the person turns 21, whichever is longer.That's in addition to the current punishment that depends on the cost of the damage; less that $500.00 is a misdemeanor subject to 60 days in jail and a fine up to $500.00; more than $500.00 is also a misdemeanor but carries a maximum imprisonment of three years and a fine of up to $2,500.00. A court also can order an individual to pay restitution and perform community service. The County has issued more than 2,700 juvenile citations for graffiti vandalism over the past three years. Note: If you like this proposal, give Delegate Kipke a call. Reported in The Sun papers February 13,2008, a bill that would ban "Texting" by drivers.The bill would prohibit drivers from using a device such as a cell phone or Blackberry to write, send or read text messages while operating a vehicle. A violation would be considered a misdemeanor subject to a maximum fine of $500.00. Del.Anthony O'Donnell was skeptical. Do not know if this Bill has passed as of yet. HB276 To Prohibit a person from standing in a highway in Anne Arundel County to solicit money or donations from an occupant of a vehicle; prohibiting a person from standing in a highway. Panhandling will be illegal effected October 1,2007. HB 713 Creates a new offense relating to criminal gangs and authorizes the attorney general to aid in investigations and prosecute violations. "Criminal gang" is defined as a group or ongoing association of three or more persons whose members engage in a pattern of criminal activity, have as one of their primary objectives on one or more crimes and have in common an identifying sign, symbol,name,leader or purpose. A violator can be imprisoned for not more than 10 years, or 20 years if death to a victim occurs and/or a fine not exceeding $100,000. HB 1036 Identity Theft ( A person from knowingly and willfully claiming to represent another person without the knowledge and consent of that person, with the intent of soliciting, requesting, or taking any other action to induce another to provide personal identifying information or a payment device number. A person who violates can be imprisoned up to 18 months and/or be fined $5,000. |

Smoking Law The Maryland Senate approved the NO SMOKING law that will take effect on February 1,2008. This would cover all public places with the exception of Tobacco Shops. Businesses that would have a financial hardship would be allowed to apply for a waiver that would be controlled by the State Department of Health and Mental Hugiene. I know of one place of business that tried to apply for a waiver, they were refused the waiver and was told they were not handing any out. I checked on this and from what I understand, the waiver part was agreed on just to get the law passed. There was no intention on allowing waivers which would expire on 2011 and would not be renewable. PENALTIES Penalties set for establishments that violate the ban on smoking. For the violation of the ban the first time a written reprimand would be given, the second time they would be fined $100.00, for each subsequent violation they would be fined $250.00 each. Smoking and the Movies have gone together for many years. According to the May 11,2007 edition of the Sun Papers, films will now get a tougher rating if their characters light. The Motion Picture Association of America said that smoking will be considered when rating movies and that "depictions that glamorize smoking or movies that feature pervasive smoking outside of an historic or other miti - gating context may receive a higher rating. Smoking will become a factor in decisions by the Classification and Rating Administration ,along with violence,language, nudity,drug abuse and other elements. The Walt Disney Company will eliminate smoking from all its films released under its label and will discourage smoking in films released under its Touchstone and Miramax brands, the company said. Disney President Robert Iger made the pledge in concern regarding deaths due to cigarette smoking. The Company would encourage theater owners to show an anti-smoking message before screening films that depict characters lighting up. The Universal Pictures also said they instituted a policy to reduce smoking in youth-oriented films in April.They will include a health warnng with films that include smoking. This was reported by Universal Studios President Ron Meyer. In May, the Motion Picture Association of America said it would begin considering smoking as a factor in rating films. The Sun papers reported on December 22,2007 that the State Department of Health has proposed regulations that would apply the state's ban on smoking in bars and restaurants to certain outdoor areas. Bruce C.Bereano, a lobbyist for the state's tobacco wholesalers, said his clients would fight the regulations. He said the legislature did not intend or mean or provide for any prohibition of smoking activities outside the walls of the restauran, period, this is wrong and is overstepping the intent of the legislation. Note: Might be a good thing to include drugs and crime on this in the future. |

As reported in the July 7,2008 of the Sun Papers, many Marylanders have had their arrest records removed from public view because of a new State law passed about nine months ago, October 1,2007 that requires automatic expungement for those who are detained and released without charge. Since the law was passed, there were 7,092 automatic expungements through May31. More than 6000 originated in Baltimore Another major change in state expungement law takes effect October 1,2008, when some criminal convictions in Maryland can be wiped out without a pardon from the Governor. The following will be allowed to be expunged, nuisance crimes including public urination, panhandling,drinking alcohol in a public place and riding mass transit without paying the fare. It also covers nuisance crime convictions before October 1 this year, according to the state Department of Legislative Services, but it does not cover drug convictions.Those who are convicted of nuisance crimes are required to apply for expungement. They must wait for 3 years after the conviction or the sentence is completed. Maryland Law bars employers from requiring disclosure of expunged criminal charges in an application or interview. A person's refusal to disclose information about criminal charges that have been expunged also may not be the sole reason for an employer to fire or refuse to hire that person, state law says. |

Responsible for investigation of all burglaries reported to the Eastern District, plus other special investigations at the discretion of the District Commander , to include serious assults, stabbings and shootings that do not result in deaths and domestic assults, street robberies and RR& E incidents. Will also include follow ups on criminal incidents that exceeds the abilities and limitations of the patrol Officers. Sergeant Kathy Pleasant #849 Supervisor, Eastern District Pact Unit. Responsible for the resolution of Community issues to include disorderly house com - plaints, loitering in the community park areas and other quality of life disruptions. Will attend community meetings and act as a liaison between the communities and the Captain, execute other special initiatives at the direction of the commander to include bike patrols, foot patrols and covert operations. Sergeant Leroy Coking #1071 Supervisor, Eastern District Tactical Patrol Unit. Is a special unit that is responsible for the investigation of street level CDS comlaints, street gang activities, and other criminal activities that are not being investigated by the CID section or other components of the Police Department. They are responsible to the Assistant Commander. Corporal Wayne Tanis # 722 Eastern District Traffic Coodinator. Responsible for handling all traffic related problems that are received at Eastern District such as speeding vehicles, reckless driving, parking complaints, abandoned vehicles and commercial vehicles in residential areas. Will develop and assign traffic enforcement details to patrol officers. The Coordinator will then collect and collate the information for possible further action with the traffic engineering department should it be warranted. Will also assist in the tactical planning for special events that involve traffic coordination and road closures (parades etc.). Detective Timothy Utzig #1241 Eastern District Domestic Violence Officer. The Domestic Violence Officer(DVO) is tasked with the follow-up investigations of all cases of domestic and family violence. This includes harassment, stalking and viola - tions of protection orders. The DVO will also assist the victim of domestic violence throughout the criminal and civil proceedings. In addition, the DVO will provide - referrals for counseling, mediation,relocation and any other action that is needed to bring stability and normalcy to the victim. Congress oks Energy Bill In the February 21,2007 sunpaper, it reported that Australia announced plans to phase out incandescent light bulbs and replace them with efficient compact flourescent bulbs across the country.Their claim is that electricity flows through a filament to create light, but much of the energy is wasted in the form of heat. Also I saw an article, somewhere in California they are doing away with some incandescent light bulbs. Congress gave approval around December 18,2007 of the new energy bill.This bill calls for a ban on the 100 watt incandescent light bulb by 2012. In addition to the 40% increase in fuel efficiency for new cars and light trucks by 2020, for a fleet-wide average of 35 MPG, the bill requires a five-fold increase to 36 billion gallons-in the amount of alternative home grown fuels such as ethanol, that must be added to the nation's gasoline supply by 2022.The bill is expected to reduce energy use by 7% and carbon dioxide emmissions by 9 % in 2030.In April, the Maryland General Assembly passed a "Clean Cars" law that requires automakers to cut their fleetwide emmissions of global warming gases for all vehicles sold in the state by 30 % by 2016.

Notice Notice Notice Notice Notice High Point School Traffic Problems On December 14,2006, your President Robbie Robinson attended a meet- ing at the High Point Elementary School on Duvall Highway concerning traffic problems in front of the school. Other persons that attended were; Ed Horky, Assistant Chief of the Anne Arundel County Traffic Engineering Division, Tim Merritt - Principle of the High Point Elementary School, Corporal Wayne Tanis of the Anne Arundel County Police Department's traffic division,Phil Kijak from the Parent and Teachers Association, and Mark Chang a new representative of the Community Services of Anne Arundel County. Discussions were on the traffic problems within the school area. I have attended other meetings in the past concerning chockers that were placed temporary in front of the school to slow the traffic and make it safer for school children at school when leaving or arriving. Howard Weissberg who was this area's representative started to make plans on what could be done at the school.Before being promoted he had the temporary chockers removed and made new projected plans for a new type of chocker, this started, Ed Horky had to take his place until they hire someone to take his place. At this meeting it was decided what would be done concerning the chockers, how large of a space they would occupy, the distance between and so forth. Also there is a new type of flashing light they expect to use that if you go over the speed limit it would flash the posted speed limit.The new flashers would take the place of the present flashers. Speed would also be changed. As of this date (January 11th.) I talked with Ed Horkey and the following information was received. The new type of flasher may be installed first, they have been ordered and would take about 60 days to arrive. Ed will study to see if they can be placed at the same location of the present lights, his concern is if trees etc. would interfear persons seeing same. The speed (25MPH) limit going East on Duvall Highway will be extended to Woodlawn Avenue,the speed limit of 30 MPH on Duvall Highway going West from Fort Smallwood Road will be changed to 25 MPH starting at Woodlawn Avenue and continue to the West End of the road. At this time I'm not sure if they are going to put the chockers in at this time. We will have to wait until the lights are taken care of and then a decision would be made afterwards. Note: The flashing lights were installed near the end of August on Duvall Highway near the High Point school. If you go the speed limit of 25 or over a little, the sign will light up 25 miles per hour. If you exceed the speed limit the sign will light up and say slow down. We will have to wait and see the outcome before anything else will be done. |

Crime reporting online. Recently the Anne Arundel County Police Department launched a new crime reporting Web site,allowing victims of some property and nuisance crimes to go to www.aacounty.org/police/crimereport.cfm and fill out a police report at their leisure. It's for crimes that are less serious in nature that there are no known suspects.Such calls may include vandalism, theft up to $5,000, identify theft,credit card theft,lost property and telephone misuse.The website is meant to help the public report crimes, while keeping Officers on the streets ready for more serious crimes.The online report will be reviewed and assigned to officers and detectives for follow-up investigations when appropriate. **************************************************************************************** Cell Phones
Attempt was made to outlaw cell phones and to stop text messages while driving auto's, so far to my knowledge this law did not pass.. "Locater", All cell phones have a locater that can be set on E911 or Location on. The E911 to be active, you must be able to dial out to be located.. The best and recommended is to have the locator to be set on Location on, that way if something happens to you , the authorities would be able to trace your location. I understand there is no higher battery usage from having it on all the time. This would actually be safer for you. I could not find it on my phone, so I went to the cell phone store and they said my locator was automatically on, you should have your checked. Other things you probably don,t know about. I received the following information through the mail, you would have to check it out. First - The emergency number worldwide for mobile is 112. If you find yourself out of the coverage area of your mobile network and there is an emergency, dial 112 and the mobile will search any existing network to establish the emergency number for you, the number 112 can also be dialed even if the keypad is locked. 2nd. - Does your car have a remote keyless entry? If you lock your keys in the car and the spare keys are at home,call someone at home on their mobile phone from your cell phone. Hold your cell phone about a foot from your car door and have the person at your home press the unlock button, holding it near the mobile phone on their end. Your car will unlock. 3rd. - Hidden Battery Power - Imagine your mobile battery is very low. To activate, press the keys *3370# Your mobile will restart with this reserve and the instrument will show 50% increase in battery. This reserve will get charged when you charge your mobile next time. 4th. - How to disable a STOLEN mobile phone? To check your Mobile phone's serial number, key in the following digits on your phone! e:*#06# a 15 digit code will appear, write it down and keep it somewhere safe. If your phone is stolen, you can phone your service provider and give them this code.They will then be able to block your handset, so even if the thief changes the sim card, your phone would be useless. You probably will not get your phone back, but at least you know thry cannot use it. Have your phone's blocked from receiving certain calls. On January 28,2008, all cell phone numbers are being released to telemarketing companies and you will start to receive sales calls. You will be charged for these calls. To prevent this, call the following number from the phone you wish to have these calls blocked 888 - 382 - 1222. I understand it takes about 31 days for it to become active. It is the National DO NOT CALL LIST. I did this on my cell and also my house phone . If you continue to receive these calls after about a month, contact DO NOT CALL .Gov UPDATE In the July 16,2008 edition of the sunpapers Two companies have been cited for ignoring the Do Not Call list, Planet Earth Satellite Inc. and its President have been charged with calling consumers whose numbers are on the list, and also Star Satellite LLC based in Provo Utah was accused of making telemarketing calls that failed to connect consumers to a live telemarketer within two seconds after consumers answer the call. They were fined a total of $95,000 for ignoring the federal do not call list. Check the July 24,2008 edition of the sunpaper page 2A, concerning the use of cell phones. Cell phone use may increase the risk of brain cancer and tumors. Cell phones emit a small amount of electromagnetic radiation. It also recommends for children to use the cell phone only for emergency because their brain is still developing and their skulls are thinner. More studies are being made on this. It will be up to you to follow up dates on this in your newspapers. |

Metal Thieves This past year you may have heard about someone stealing copper wire or aluminum, even aluminum seats from our local parks. Something has to be done and cannot believe all this time that no one tried to do something to make it harder for thieves when they steal metals. Two north county lawmakers are proposing laws to try and correct the problem. Delegate Ted Sophocleus legislation, House Bill 33 requires junk dealers and scrap metal processors to keep records of purchases of scrap metal for three years Senator Ed DeGrange proposal requires that scrap metal and junk dealers record the date, description of the purchase, weight amount paid and any mark number or other identification of the metal. The dealer would also be required to get the sellers name, date of birth, drivers license number, at least two forms of identification and signature. the bill includes a variety of material, from electrical wiring to beer kegs - which recently have been target of thieves. No number has been assigned to this bill as of yet.
